IMC APPROVES THE REGULATION ON LEVEL AND MANNER OF PAYMENT OF LICENSE FEE

Under the leadership of THE Chairman Mr. Adnan MEROVCI, Independent Media Commission (IMC) on December 29, 2014 held a regular meeting, the 20th in a row. At this meeting the IMC  has adopted the IMC REGULATION 2014/03 ON THE LEVEL AND MANNER OF PAYMENT OF THE LICENSE FEE. 

IMC has reviewed the regulation based on Article 26 of the Law on IMC.

As set forth by procedures for the issuance of secondary legislation (Article 8 of the Law on IMC 04 /L-44) to 15 working days (from December 3 to December 23, 2014), IMC has made available to representatives of audiovisual media services and other interested parties to provide written comments regarding the review and completion of the License Fee. During the period prescribed for comments, IMC has received written comments which are presented as follows:

Of these pairs is required to consider the reduction of the license fee level, the opportunity to pay the fee in installments and various factors are recommended to be considered in determining the level of the license fee.

IMC would like to thank the parties for their comments on the draft regulation IMC 2014/03 on the Level and Manner of Payment for License Fee.

IMC, based on the assessment of comments made, offers the following explanation:

In the process of amending the Regulation on License Fee, IMC has not changed the level of the license fee for the various categories of licensees by IMC although, in general, positive developments have been made in the media sector since 2010.

Another fact that IMC has considered not to change the level of the license fee was also the process in the verge of which we are - the transition to digital terrestrial broadcasting. Within the legal framework for this process, IMC will issue new regulation on the level and payment of the fee for all categories of licensees of IMC in the digital terrestrial platform and other platforms.

According to the new amended regulation, the licensee of IMC will pay the same amount of fee they paid since 2011 under Regulation 2010/02 KKPM. Factors and coefficients that are calculated at the level of the license fee prescribed by Regulation KKPM 2010/02 remain the same in the IMC regulation 2014/03.

With IMC Regulation 2014/03, IMC has changed the deadline for payment of the fee by January 31 of the respective year, as has been up to now, on March 31, which will be from now on, and this was done in order to give the licensees sufficient time and have facilities for payment. IMC may not consider allowing the payment of the fee in installments due to financial complications that would entail in the process of revenue collection by the IMC in accordance with rules which are subject to budgetary organization.

Other changes in the regulation is the removal of the application of interest rates.

Law on IMC, respectively Article 26 of on the license fees, defines that the level of the fee must be the same for each category, therefore the IMC can not determine the level of payment for each licensed separately without prejudging their economic status. IMC Regulation 2014/03 on the Level and Manner of Payment for the License Fee is bylaw with general character through which are defined the rights and obligations to a wide circle of licensed entities.
