The Independent Media Commission (IMC), on February 11, 2021, held an extraordinary meeting.

In this meeting, the IMC has reviewed the legal cases related to the violations identified by the monitoring of Audiovisual Media Service Providers (AMSP) before campaign and during of the campaign for the extraordinary elections of February 14, 2021, for the Assembly of the Republic of Kosovo. The IMC monitored the media before and during the election campaign to assess their compliance with the legislation. According to the findings so far from the monitoring process, the IMC has initiated several legal cases which relate to violations of the legislation of the Independent Media Commission, namely the Law on the IMC, Regulation IMC-2017/07 on Commercial Audio-Visual Communications as well as Chapter VIII of Law no. 03 / L-073 on General Elections in the Republic of Kosovo for the implementation of which the IMC is responsible.

The Commission has reviewed all these cases of legal violations and after reviewing it has concluded that in all these cases the subjects have been found in violation of the legislation.

Regarding the legal cases of violations that the IMC has identified before the start of the election campaign, the Commission decided as follows:

• Channel 10 - is sanctioned with the measure Remark, for violation of the Regulation IMC-2017/07 on Commercial Audiovisual Communications.
• Klan Kosova - was sanctioned with the measure Remark, for violation of Regulation IMC-2017/07 on Commercial Audiovisual Communications.
• KTV - has been sanctioned with the measure Remark, for violation of Regulation IMC-2017/07 on Commercial Audiovisual Communications.
• RTK 1 - has been sanctioned with the measure Remark, for violation of Regulation IMC-2017/07 on Commercial Audiovisual Communications.
• TE 7 - is sanctioned with the measure Remark, for violation of Regulation IMC-2017/07 on Commercial Audiovisual Communications.

As for the legal cases of violations that the IMC has identified during the election campaign, the Commission decided as follows:

• Channel 10 - was sanctioned with a fine in the amount of 5000 € (five thousand euros), for violation of Law No. 04 / L-44 on the Independent Media Commission and Regulation IMC-2017/07 on Commercial Audiovisual Communications.
• TE 7 - was sanctioned with a fine in the amount of 5000 € (five thousand euros), for violation of Law No. 04 / L-44 on the Independent Media Commission and Regulation IMC-2017/07 on Commercial Audiovisual Communications.
• TV Dukagjini - was sanctioned with a fine in the amount of 7500 € (seven thousand five hundred euros), for violation of Law No. 04 / L-44 on the Independent Media Commission and Regulation IMC-2017/07 on Commercial Audiovisual Communications.
• Klan Kosova - was sanctioned with a fine in the amount of 5000 € (five thousand euros), for violation of Law No. 04 / L-44 on the Independent Media Commission and Regulation IMC-2017/07 on Commercial Audiovisual Communications.
• KTV - was sanctioned with a fine in the amount of 5000 € (five thousand euros), for violation of Law No. 04 / L-44 on the Independent Media Commission and Regulation IMC-2017/07 on Commercial Audiovisual Communications.
• RTK 1 - was sanctioned with a fine in the amount of 5000 € (five thousand euros), for violation of Law no. 03 / L-073 on General Elections in the Republic of Kosovo.
• TV Syri Vision - was sanctioned with a fine in the amount of 2000 € (two thousand euros), for violation of Law no. 03 / L-073 on General Elections in the Republic of Kosovo.
• TV Puls - was sanctioned with a fine in the amount of 2000 € (two thousand euros), for violation of Law no. 03 / L-073 on General Elections in the Republic of Kosovo.
