Announcement from the meeting of the Independent Media Commission

The Independent Media Commission (IMC), on October 18, 2021, under the chairmanship of the Chairman of the IMC, Mr. Xhevat Latifi, has held the thirteenth regular meeting for this year.

Following the approval of the agenda and minutes from the last meeting, according to the agenda, the IMC has reviewed legal cases related to violations identified by the monitoring of Audiovisual Media Service Providers (OSHMA), during the campaign for local elections of October 17, 2021.

Independent Media Commission in order to assess the compliance of the media with the Guideline for the implementation of Chapter VIII of the Election Law no. 03 / L-073 for the implementation of which the IMC is responsible, has monitored the Audiovisual Media Service Providers during the election campaign. According to the findings of the monitoring process, the IMC has initiated several legal cases which are related to violations of the legislation of the Independent Media Commission

The Commission has reviewed all these cases and after reviewing has decided as follows:

  •     Channel 10 is sanctioned with a fine in the amount of two thousand (2,000) Euros for violation of the Regulation IMC-2017/07 on Commercial Audiovisual Communications and the Code of Ethics KKPM-2016/03.
  •     Klan Kosova is fined in the amount of two thousand (2,000) euros for violation of Regulation IMC-2017/07 on Commercial Audiovisual Communications Code of Ethics KKPM-2016/03.
  •     RTK 1 is sanctioned with a fine in the amount of two thousand (2,000) Euros for violation of the Law on Elections no. 03 / L-073 and the Code of Ethics KKPM-2016/03.
  •     TE7 is fined in the amount of two thousand (2,000) euros for violations of Regulation IMC-2017/07 on Commercial Audiovisual Communications, Code of Ethics KKPM-2016/03 and Election Law no. 03 / L-073.
  •     TV Dukagjini is fined in the amount of two thousand (2,000) euros for violation of Regulation IMC-2017/07 on Commercial Audiovisual Communications and the Election Law no. 03 / L-073.
  •     KTV is fined in the amount of two thousand (2,000) euros for violating the Regulation IMC-2017/07 on Commercial Audiovisual Communications and the Code of Ethics KKPM-2016/03.

Following the meeting, the Commission addressed several requests in licensing cases.

The reviewed cases concerned requests for licensing of media service providers through the distribution operator. The reviewed licensing cases are listed as follows:    

  •     TëVë  Action - Decision on licensing of media service providers with broadcasting through Distribution Operators;
  •     TëVë Drama - Decision on licensing of media service providers with broadcasting through Distribution Operators;
  •     To Fantasy - Decision on licensing of media service providers with broadcasting through Distribution Operators;
  •     To Comedy - Decision on licensing of media service providers with broadcasting through Distribution Operators;
  •     TëVë Novela - Decision on licensing of media service providers with broadcasting through Distribution Operators;
  •     TëVë Shqip - Decision on licensing of media service providers with broadcasting through Distribution Operators;
  •     To Kids 1 - Decision on licensing of media service providers with broadcasting through Distribution Operators;
  •     TëVë Kids 2 - Decision on licensing of media service providers with broadcasting through Distribution Operators;
  •     TëVë Doku 1 - Decision on licensing of media service providers with transmission through Distribution Operators;
  •     TëVë Doku 2- Decision on licensing of media service providers with broadcasting through Distribution Operators; AND
  •     AVMS TARGET - Decision to change the name in TëVë 1.

After reviewing the recommendations of the Executive Office for each of the above cases, the Commission concluded that all the requirements met the legal criteria of the IMC and decided to approve all the recommendations.
