Announcement from the meeting of the Independent Media Commission

The Independent Media Commission (IMC), on August 29, 2022, under the leadership of the Chairman of the IMC, Mr. Xhevat Latifi, held its thirteenth regular meeting for this year.

After the approval of the agenda and minutes from the last meeting, according to the agenda, the Commission has considered several legal cases.

The Independent Media Commission, in order to assess the compliance of the licensees with the by-laws of the KPM, has carried out their monitoring. According to the findings of the monitoring process, the IMC has initiated several legal cases related to violations of the legislation of the Independent Media Commission.

The Commission has reviewed these cases and after the review has decided as follows:

  • Channel 10 – violation of Regulation KPM-2013/01 for the Protection of Children and Minors in Audiovisual Media Services. After the examination, the Commission decided to sanction OSHMA Kanal 10 with the measure of Remark;
  • Klan Kosova – violation of Regulation KPM-2013/01 for the Protection of Children and Minors in Audiovisual Media Services. After the examination, the Commission decided to sanction OSHMA Klan Kosova with the measure of Remark;
  • KTV – violation of Regulation KPM-2013/01 on the Protection of Children and Minors in Audiovisual Media Services. After the examination, the Commission decided to sanction OSHMA KTV with the measure of Remark;
  • MTV Kosovo – violation of Regulation KPM-2013/01 for the Protection of Children and Minors in Audiovisual Media Services. After the examination, the Commission decided to sanction OSHMA MTV Kosova with the measure of Remark;
  • TE 7 – After consideration, the Commission decided to postpone this case to the next meeting;
  • TV Mir – violation of Regulation KPM-2013/01 for the Protection of Children and Minors in Audiovisual Media Services. After the review, the Commission decided to sanction OSHMA TV Mir with the measure of Remark.

According to the agenda, the Commission also dealt with several licensing cases. The reviewed cases were related to requests for: change of ownership, licensing of OSHMA through the distribution operator. After reviewing the recommendations of the Executive Office for these cases, the Commission decided as follows:

  • Big Brother 1 - request for OSHMA licensing through the distribution operator, postponed to the next meeting;
  • Big Brother 2 request for OSHMA licensing through the distribution operator, postponed to the next meeting;
  • Radio Aktiv – The request for change of ownership is approved.

Also, the Commission has examined the issue of approving the General Terms and Conditions of the License for OSHMA on Demand as well as the "Video on Demand" Application Form. After consideration, the Commission decided to postpone this item to the next meeting.

The Commission has also reviewed the proposal for the establishment of the "Commission for the evaluation of applications for the license of the KPM", after the review, the Commission approved this decision.

The Commission has also approved the Monitoring Report "Protection of Children and Minors in Audiovisual Media Services", which monitoring was carried out during the month of July 2022.
