The Independent Media Commission (IMC), on September 19, 2022, under the leadership of the Chairman of the IMC, Mr. Xhevat Latifi, held its fourteenth regular meeting for this year.

After the approval of the agenda and the minutes from the last meeting, according to the agenda, the Commission has reviewed several legal cases that had to do with violations of Article 28, paragraph 1 and 2 of the IMC Law, respectively the failure to submit the annual report to the IMC.

On July 12, 2022, the IMC Commission made a decision to sanction with a warning for violation of Article 28, paragraph 1, and 2 of the IMC Law AVMSs that have not submitted the annual financial report for 2021 Despite this, the OSHMAs listed below have failed to act in accordance with the IPC Law, by not submitting the annual report for 2021 even after the sanctioning measure Remarks. Therefore, the IMC, after reviewing the recommendations for these cases, decided on sanctioning measures with a fine for violation of Article 28, paragraph 1 and 2, of the IMC Law, against these licensees:

Radio Dardania-€2000, Radio Helix-€2000, MBTV-€2000, Radio Borzani-€2000, Radio Kaçaniku-€2000, Fwf City Radio-€2000, TV Vali-€2000, TV Llapi-€2000 and 1tv- 2000 €, Rahovec Channel-1000 €, Isp Broadcast – 1000 €, Iptv Tech Llc-2000 €, Vision Tv-2000 €, Max Tv-1000 €, tel Communications Llc.-1000 €, Comnet-A-2000 € , Radio Kent FM 2-1000 €, Radio Klokot-2000 and Radio Dodona-2000 €.

All the aforementioned licensees are also ordered to submit the completed annual report for the year 2021 within a period of ten (10) days, as defined by Article 28, paragraph 1 and 2 of the Law on the IPC.

According to the agenda, the Commission also dealt with several licensing cases. The reviewed cases were related to requests for: licensing of OSHMA through the distribution operator, change of ownership and recommendation for the announcement of the public tender for free radio frequencies. After reviewing the recommendations of the Executive Office for these cases, the Commission decided to approve the following cases:

• The request for the change of ownership of Radio Club FM and AVMS 1 TV is approved;
• The request for the change of ownership of Radio Rinia is approved;
• The recommendation for announcing the public tender for free radio frequencies in the Turkish language in the municipality of Prizren is approved - the Commission approved the recommendation;
• The General Terms and Conditions of the License and the Application Form for On-Demand AVMS are approved;
• The report of the Application Evaluation Committee regarding the evaluation of the applications (documents) received in the public competition for radio licenses in Vitomirica. The Commission has reviewed the report and has concluded that the legal criteria of the IMC have not been met, therefore it has decided to re-announce the competition.

While two requests for licensing OSHMA Bigbrother 1 and Bigbrother 2, the Commission decided to postpone them to the next meeting.

Also the Commission has considered some recommendations for interruption of broadcasting. IMC, in order to assess the compliance of AVMS-s with the General Terms and Conditions of the License and Regulation IMC-2021/01 for Audio and Audiovisual Media Service Providers, has carried out several monitoring where it has resulted that the following AVMS-s are found in continuous violation of the General Terms and Conditions of the License, IMC-2021/01 Regulation for Audio and Audiovisual Media Service Providers, IMC-2017/06 Regulation on the Annual License Fee and the IMC Law:

• Labia TV
• Olti TV
• Tribune Channel
• Dialog TV
• TV Kosova Channel

After reviewing the cases, the Commission decided that the above-mentioned AVMS-s should be sanctioned with the suspension of the broadcasting license based on Article 30 paragraph 1.6 of the Law of the IMC, for the continuous violations of Article 4.6, of the General Terms and Conditions of the License , article 24 of the Regulation for Audio and Audiovisual Media Service Providers-IMC-2021/01, article 13 paragraph 1 of the Regulation IMC-2017/06 on the Annual License Fee and article 28, paragraph 1, and 2 of the Law of IMC.
