The Independent Media Commission (IMC) on November 24, 2023, under the leadership of the Chairman of the IMC, Mr. Jeton Mehmeti has held the eleventh regular meeting for this year. In this meeting, the Commission addressed several items on the agenda: license renewal cases and legal cases.

Regarding the licensing cases, the Commission has examined several cases of the nature of licensing, respectively 7 requests for renewal of the radio license and one request for renewal of the license of the distribution operator.

After review, the Commission has approved the license renewal requests for: Radio 7 Kosova, Radio Furtuna, Radio Bambus and Radio Llapi. While he postponed for decision-making in the next meeting the requests for renewal of the license from: Radio Alba, Radio Klan Kosova Prishtina, Radio Klan Kosova Deçan and distribution operator Art Motion.

Regarding the legal cases, the Commission has examined several cases for violation of the legislation of the IMC. After the review, the Commission has found the following licensees in violation:

• Distribution operator Niart, violation of Regulation KKPM -2020/01 for the Distribution of Audio and Audiovisual Media Service Providers - sanctioned with a fine of 2000 euros.

• Channel 10, violation of the Code of Ethics KKPM-2016/03 for Media Service Providers in the Republic of Kosovo - sanctioned with a fine of 1000 euros.

•ATV, the violation of Regulation KPM-2013/01 for the Protection of Children and Minors in Audio-Visual Media Services - is sanctioned with a Warning.

• Klan Kosova - violation of the Code of Ethics - sanctioned with a fine of 5000 euros

While after the examination by the Commission, the following legal cases were not found to be in violation:

• TV Dukagjini, violation of the Code of Ethics KKPM-2016/03 for Media Service Providers in the Republic of Kosovo - The complaint is rejected as unfounded.

• KTV, violation of the Code of Ethics KKPM-2016/03 for Media Service Providers in the Republic of Kosovo - The complaint is rejected as unfounded.

• KTV & ARTA, violation of the Code of Ethics KIMC-2016/03 for Media Service Providers in the Republic of Kosovo - The complaint is rejected as unfounded.

Following the meeting, the Commission reviewed 19 other legal cases for violation of the Law on the IMC, respectively for not submitting the annual financial report:

Radio 7 Kosova, Radio 7, IPTV Tech, Radio Energji, Radio Rinia, TVR, Premier Songs, TV 7, Big Brother 1, Big Brother 2, Radio Maria, TV Diaspora, Radio Gjilani, Kugo TV, Conect 3, Glam Radio, Radio Romano Avazo, Radio Prizreni, and Radio Victoria.

After the review, the Commission decided that all the above-mentioned licensees should be sanctioned with a Warning, in accordance with Article 30, paragraph 1 of the Law of the IMC, for violation of Article 28 of the Law of the IMC. All licensees in question are also ordered to submit the annual report for 2022 within 15 days, as defined by article 28, paragraph 1 and 2 of the Law of the IMC.

According to the agenda, the Commission has also examined several legal cases for the change of ownership without the approval of the IMC. After the review, the Commission found that all the following licensees have violated Article 21 paragraph 3 of the IMC Law, Article 18 of the Regulation for Audio and Audiovisual Media Service Providers IMC-2021/01, Article 15 paragraph 2. paragraph 2.1, and paragraph 3 of the General Terms and Conditions of the IMC License, making a change of ownership, without the prior approval of the IMC, as defined by legislation. The Commission decided the sanctioning measures as follows:

•Top Radio, change of ownership, without prior approval of the IMC - sanctioned with a fine of 1000 euros.

• TV Llapi, change of ownership, without prior approval of the IMC - sanctioned with a fine of 2000 euros.

• TV wedding, change of ownership, without prior approval of the IMC - sanctioned with a fine of 2000 euros.

• TE 7, change of ownership, without prior approval of the IMC - sanctioned with a fine of 5000 euros.

• BB Herc, change of ownership, without prior approval of the IMC - sanctioned with a fine of 5,000 euros.

•Job Net, change of ownership, without prior approval of the IMC - sanctioned with a fine of 3000 euros.

•Radio Capital FM, change of ownership, without prior approval of the IMC - sanctioned with a fine of 1000 euros.

•Radio Dukagjini, change of ownership, without prior approval of the IMC - sanctioned with a fine of 2000 euros.

• TV Dukagjini, change of ownership, without prior approval of the IMC - sanctioned with a fine of 3000 euros.

•Radio Mir, change of ownership, without prior approval of the IMC - sanctioned with a fine of 1000 euros.

• TV Mir, change of ownership, without prior approval of the IMC - sanctioned with a fine of 1000 euros.

•Radio Impuls, change of ownership, without prior approval of the IMC - sanctioned with a fine of 1000 euros.

•Radio Vizion, change of ownership, without prior approval of the IMC - sanctioned with a fine of 1000 euros.

• TV Dielli was found to have notified the IMC in advance in writing for other reasons
